Delta County residents, mark your calendars for Wednesday, February 28th, 2024, because this is the day that will go down in history.

In the midst of COVID chaos, the first land use code forced zoning on the unincorporated areas, without proper notification and violating Supreme Court standards. 
The current 229-page revision claims to simplify the development process, but is fundamentally the same as the rejected 2023 version. Even the planning commission did not recommend it, raising ethical concerns and criticizing it for being arbitrary. These land use regulations are standard procedure for developers, not for everyday folks. Who is the government trying to regulate?

The code restricts property rights by turning them into privileges, subject to government discretion. This Land Use Code means whatever the commissioners want to pretend it means on any given day, making the law unknowable, unpredictable, inconsistent, arbitrary, and nonsensical. Despite some rights being "given back" in this version, it is clearly an incremental erosion of freedom.

The county commissioners decided not to implement the Planning Commission's (PC's) recommendations because they would have to start the legal process all over again but are asking for input from the community. If we expect to be ignorant and free we expect the impossible! Come to the hearing and voice your opinion. Let's show we are not asleep.

The public hearing is a historic event for Delta County. It's a chance for residents to come together and make a stand against county overreach with land use code implementation. Bring your friends, family, and neighbors, and let's make sure that Delta County officials hear us loud and clear.
